These terms and conditions apply to the use of this website and to quotations, offers and agreements from WMG Technical Installations, part of World Wide Mobility Group, registered at Schiedamsedijk 126a, 3134 KK Vlaardingen, Netherlands.
Scope
These terms apply to every quotation, order confirmation and agreement unless expressly agreed otherwise in writing. Any purchasing or other general conditions of the client are expressly rejected unless we have accepted them in writing.
Quotations and scope of work
All quotations are without obligation and remain valid for 30 days unless stated otherwise. Quotations are based on the information provided by the client and on the findings of the site survey.
Work outside the agreed scope is additional work and will be quoted separately and confirmed in writing before it is carried out. Scope changes requested by the client may affect both price and planning.
Execution of the work
We carry out the work with due care and in line with the agreed specification and applicable standards. Stated installation windows are planned in good faith and depend on site readiness, access, hardware lead times and third party works.
The client provides timely and safe access to the site, accurate site information, and the facilities reasonably required to carry out the work, including power, access routes and any escorts or clearances the facility requires.
Client obligations
The client is responsible for the accuracy of the information provided, for obtaining any permits or facility approvals required, and for ensuring the site is available at the agreed time. Delays or costs arising from inaccurate information or unavailable access may be charged.
Prices and payment
Prices are exclusive of VAT unless stated otherwise. Unless agreed otherwise, invoices are payable within 30 days of the invoice date. If payment is not made on time, statutory commercial interest and reasonable collection costs may be charged.
Delivery and handover
Work is considered delivered once it has been tested and handed over with the agreed documentation. Minor items that do not prevent use of the installation do not postpone handover and will be resolved within a reasonable period.
Warranty
We warrant that the work is carried out properly and in line with the agreed specification. Warranty on supplied hardware is limited to the warranty provided by the manufacturer. The warranty does not cover defects arising from use contrary to instructions, modifications by third parties, or normal wear.
Liability
Our liability is limited to the invoice value of the relevant assignment and, in any event, to the amount paid out by our liability insurer in the relevant case. We are not liable for indirect or consequential loss, including loss of profit, loss of data or business interruption, except in cases of intent or deliberate recklessness.
Force majeure
We are not liable for delay or failure caused by circumstances beyond our reasonable control, including supply chain disruption, strikes, restrictions on site access, or failure of third party utilities.
Applicable law
Dutch law applies to all agreements. Disputes will be submitted to the competent court in the district where our registered office is located, unless mandatory law requires otherwise.
